This Information Manual is published in compliance with Section 51 of the Promotion of Access to Information Act, 2 of 2000 ("PAIA"). It is intended to help any person understand what records NoziConsults (Pty) Ltd holds, how to request access, and their related rights.

2. Guide under Section 10
The Information Regulator has published a Guide on how to use PAIA. The Guide is available in all official languages on the Regulator's website, inforegulator.org.za, or by contacting the Regulator directly.

3.1 Records held under legislation
- Companies Act, 71 of 2008 (statutory records, resolutions, annual returns)
- Tax Administration Act, 28 of 2011 and Income Tax Act, 58 of 1962 (returns, working papers, supporting documents)
- Value-Added Tax Act, 89 of 1991 (where applicable; NoziConsults is not currently a registered VAT vendor)
- Basic Conditions of Employment Act, 75 of 1997 and Labour Relations Act, 66 of 1995 (if and when employees are hired)
- Financial Intelligence Centre Act, 38 of 2001 (client due diligence records)
- Protection of Personal Information Act, 4 of 2013 (processing records, consents, breach logs)

3.4 Records held internally (access on formal request)
- Client engagement files and working papers
- Internal financial records
- Employee and contractor records
- Correspondence and communications records
4. How to request access
- Complete the prescribed PAIA Form 2 (available from the Information Regulator website).
- Email the completed form to info@noziconsults.com, marked "PAIA access request".
- Provide sufficient detail to enable us to identify the record, the requester, the form of access preferred and the right being exercised or protected where applicable.
- Pay the prescribed request and access fees (see Section 6 below).
5. Grounds for refusal
We may refuse access where PAIA requires or permits us to, including where:
- disclosure would unreasonably breach the privacy of a third party;
- the record is subject to legal professional privilege;
- disclosure would breach a duty of confidence owed to a third party;
- disclosure would reveal confidential commercial information of a third party;
- the record is subject to the research, safety or operational-integrity exemptions in PAIA.
6. Fees
Fees are levied as set out in the regulations to PAIA, as updated from time to time. The schedule includes:
- a request fee payable on lodging a request;
- an access fee based on the format and volume of the record;
- reproduction and search fees where applicable.
We will provide a written fee estimate before processing any request.
7. Remedies
If your request is refused, or if you are dissatisfied with how your request was handled, you may:
- lodge an internal appeal with NoziConsults (Pty) Ltd;
- lodge a complaint with the Information Regulator at PAIAComplaints@inforegulator.org.za;
- apply to a competent court for appropriate relief.
8. Availability and updates
This manual is published on the NoziConsults website and available on request in writing. We review and update it at least annually, or sooner if our records, operations or applicable law change.
